Description

The Construction Contract is a legal document designed for a construction site in building in Suffolk, outlining the agreement between the Contractor and the Owner for the construction of a residential project. Key features include the scope of work, identifying the specific project plans, and defining the work site location. The form requires the Contractor to obtain necessary permits and addresses soil condition liabilities, ensuring clarity on responsibilities related to excavation or grading. Moreover, it stipulates insurance requirements for the Contractor and mandates the provision of a boundary survey and title opinion by the Owner before construction begins. Changes to the project scope can be made through written Change Orders, with costs adjusted accordingly. Payment terms, including options for cost-plus or fixed-fee arrangements, are clearly articulated, along with late payment penalties. The warranty outlined in the contract ensures coverage for workmanship defects within a one-year period. This contract is essential for attorneys, partners, owners, associates, paralegals, and legal assistants involved in construction projects, providing a structured approach to managing responsibilities, financial aspects, and legal protections.
