The Freedom of Information Act (FOIA) is a federal law that is not applicable to requests for records of a state agency. As a result, we construe requests made under FOIA as inquiries under the California Public Records Act, the law which is applicable to California state government agency records.
The Act provides for two types of access. One is a right to inspect public records: “Public records are open to inspection at all times during the office hours of the state or local agency and every person has a right to inspect any public record, except as hereafter provided.”
1. Communications on PEDs or personal accounts involving the conduct of the public's business may be public records subject to disclosure. Such writings include, but are not limited to, ernails on personal computers and text messages and voice messages on personal cell phones.
