PHOENIX — On Jan. 17 the Fifth Circuit Court of Appeals ruled that the Deferred Action for Childhood Arrivals (DACA) program was unlawful, causing concerns for some Arizonans.
DACA recipients are not required to tell employers they have DACA. Employers are not expected to know which employees, if any, have DACA, and the DACA court decisions do not require employers to review Forms I-9, reverify employment authorization, or take any action at all.
The DACA program took root in 2012, through an Executive Order during President Barack Obama's administration, as a way to provide temporary relief (renewable 2-year terms) from deportation and work authorization for certain individuals who came to the United States as children.
DACA recipients have been able to travel to any U.S. territory, such as Puerto Rico, since the end of 2021. In addition, DACA recipients can travel domestically within the U.S. To travel internationally, DACA recipients must apply and get approved for advance parole.
