FAQ

Within the United States If you decide to get married in the United States, you will be eligible to apply for Adjustment of Status (AOS). This is an internal process that allows you to stay with your spouse in the United States and possibly work while your case is processed.

Getting married doesn't give you the right to reside in the US. You stay as long as your visa allows, be it 90=days for a tourist visa or a marriage visa. After that you will have to return home and begin the visa process from outside the country.

If you would like to travel to get married to a U.S. citizen in the United States and then stay in the U.S. to live there permanently, you will need to apply for and obtain a fiancé(e) visa. If a fiancé(e) visa is issued, you must marry within 90 days of your arrival in the United States.

A fiance visa or a spousal visa is usually the best option. The fiance visa is faster for her to be able to legally move to the US permanently. They both take about the same amount of time before she can work in the US, around 8 months normally but probably longer with covid.

If you are a U.S. citizen you have two ways to bring your foreign spouse (husband or wife) to the United States to live. They are: Immigrant visa for a Spouse of a U.S. Citizen (IR1 or CR1) - An immigrant Petition for Alien Relative, Form I-130 is required.

Fiancé(e) status automatically expires after 90 days. It cannot be extended. Your fiancé(e) should leave the United States at the end of the 90 days if you do not marry. If your fiancé(e) does not depart, he or she would violate U.S. immigration law.

If you overstay your visa and are not married to a U.S. citizen, you may be subject to penalties, including a three- or ten-year bar from reentering the United States. If you are married to a permanent resident and wish to adjust your status, you will typically need to wait for a visa number to become available.

How long do we need to be together? Texas law does not require the couple to be together for a specific period of time before they can declare themselves to be in a common law marriage. As long as both parties agree to the three elements listed in Section 2.401, they meet the requirements of a common law marriage.

If you are a US citizen and single, you can marry your girlfriend and file an I-130 petition for her at any time. If she has no criminal record or prior unlawful presence issues before her last entry, she can apply for adjustment at the same time.
