Several Southern California cities—including Hermosa Beach, Laguna Beach, Manhattan Beach and Santa Monica—ban Airbnb rentals. Websites such as Airbnb and VRBO have given rise to a sharing economy in which people rent their places while away or provide an extra room to a stranger.
Only permanent residents of San Francisco are allowed to be short-term hosts. To be a permanent resident, you must reside in your unit for at least 275 nights per year. Absentee owners who live in San Francisco less than 275 days per year are not eligible to engage in short-term rentals.
Can I rent my ADU in San Jose? Yes, many homeowners we've worked with in San Jose rent out their ADUs, given the high demand for housing and high rents. Short-term rentals of less than 30 days are not allowed in San Jose, but you can rent out your ADU on platforms like Airbnb for 30+ days.
The city of San Jose permits Airbnbs in single-family, two-family, and multi-family dwellings, mobile homes, live/work units, and guest houses. It does not permit Airbnbs in accessory dwelling units. The city municipal code permits hosting in all legal residences as per above mentioned housing types.
San Jose's Short-Term Rental Ordinance Key provisions include: Annual Rental Caps: A limit of 180 days per year when the host is not present. Zoning: Ensuring rentals align with local neighborhood zoning regulations. Permitting: Hosts must obtain a permit or registration with the city.
This means that HOAs can prohibit short-term rentals, such as Airbnb and VRBO listings which would rent the unit or lot or room within the unit or lot while the owner still occupies it, if they don't require a minimum lease term longer than 30 days.
