In Utah, two key laws govern homeowners associations ("HOAs") and inium owners associations ("COAs"). The inium Act, Utah Code § 57-8, applies to COAs, and deals with individually owned units supported by collectively held facilities and areas, such as iniums or townhomes.

4. What powers do HOAs in Utah have? Homeowners associations may collect dues for the maintenance of common areas, restrict or prohibit rentals, impose reasonable fines, access and maintain common spaces, and foreclose on properties in its jurisdiction for unpaid assessments.

It may maintain the road lots, open spaces and other facilities. Additionally, it may regulate the use, maintenance, repair, replacement and modification of common areas and cause additional improvements to be made part of the common areas. However, this right should not contradict with the approved subdivision plan.

In homeowners association cases, the Complaint shall be filed in the RAB which has jurisdiction over the region where the association is registered with the DHSUD.

The main difference is that covenants dictate property-related restrictions, while bylaws govern how the HOA operates — things like board elections, meeting procedures, and voting rights. Because covenants are recorded with the property deed and tied to real estate law, they generally hold more weight.
