Safety Requirement Background Every pool in California over 18" deep needs a fence around it, per the California Safety Code.

Pool Safety Walk, don't run. The number one pool safety rule is to never, ever run near a swimming pool. Listen to instructions and obey pool rules. No diving in the shallow end. No roughhousing. Don't play around drains and covers. Never swim alone. Sun safety is part of the deal. Use pool safety equipment properly.

There is no federal pool fence law currently in place within the United States. However, several states, including Florida and Arizona, have created their own individual pool fence laws.

Barriers and Fencing An above-ground pool must have barriers or fences to prevent access. Some communities consider the pool's vertical walls to be an adequate barrier, however, others require strict fencing. Where fencing is mandatory, the minimum height is 1.2 metres.

How close can you build a pool to your home? Local building codes typically require pools to be at least 5 to 10 feet away from the house foundation. Always check your county's regulations for specific requirements.

Fences. Any outdoor pool containing water more than 24 inches in depth – including spas, hot tubs and whirlpools − must be surrounded by a non-climbable fence that is at least five feet in total height. If a gate is placed in the fencing, it must be self-closing and self-latching.

Per the Minnesota State Building Code, Above-Ground pools that exceed 5,000 gallons and has a depth capacity of 2-feet or more require a building permit.
