The easiest way to start the process of evicting a commercial tenant is to file for a Possession Claim from the County Court. The Government has an online Court and Tribunal Finder and you'll need to find the court which is closest to the commercial property itself.
For month-to-month tenants, a landlord must provide at least 30 days' notice if the tenant has lived in the property for less than a year, 60 days if they have lived there for one to two years, and 90 days if they have lived there for more than two years.

The landlord of an intention not to renew the lease. (General Obligations Law § 5-905).
