Description

The parties may agree to a different performance. This is called an accord. When the accord is performed, this is called an accord and satisfaction. The original obligation is discharged. In order for there to be an accord and satisfaction, there must be a bona fide dispute; an agreement to settle the dispute; and the performance of the agreement. An example would be settlement of a lawsuit for breach of contract. The parties might settle for less than the amount called for under the contract.

FAQ

What happens after my exam? VA will review all the evidence in your file, assign your disability rating, and send you a decision notice (a letter letting you know your disability rating). Each claim is different, but it usually takes us about 3 to 4 months to process a claim from start to finish.

C&P exams are not required for every claim, and it's entirely possible to receive a VA rating without one. C&P exams are only necessary when the VA needs more information to determine the extent of your disability, the connection between your service and disability, or the value of your compensation.

Getting a 100% PTSD rating from the VA is next to impossible. A 70% rating (the most common) is a high hurdle in it's own right. To achieve a 100% PTSD rating, it means you would literally have to be almost totally unable to function in everyday life.

There's a link between your current condition and the event, injury, or disease that happened during your service. Usually we need medical records or medical opinions from health care providers to support this link. We may also accept lay evidence, like a buddy statement (VA Form 21-10210).

You'll need to request a copy of the final exam report. You can't get the results at your exam or directly from the provider. To request a copy of the exam report, you'll need to fill out a Freedom of Information Act or Privacy Act Request (VA Form 20-10206).

A Compensation and Pension (C&P) exam is a medical examination performed by a healthcare provider to evaluate a veteran's disabilities and determine the level of disability compensation they may be eligible to receive from the Department of Veterans Affairs (VA).

Under 38 CFR 4.125, for a diagnosis of PTSD the VA uses the Diagnostic and Statistical Manual of Mental Disorders, Fifth Edition (DSM-5). DSM-5 lists 8 Criterion dealing with a PTSD, classified as Criterion A through H.

Generally, veterans will attend a Compensation & Pension (C&P) examination and the examiner will use a goniometer to measure how far they can bend forward, backward, and side to side. VA will use these range of motion measurements to determine the severity of a veteran's back condition.

Your C&P examination is your opportunity to discuss with a VA examiner what caused your knee injury or condition and its disabling effects. It is also the opportunity for the VA to perform testing for range of motion on you to better understand the nature of your disability and its symptoms.
