This diversion program gives a person who has been charged with a first-time offense an opportunity to seek rehabilitation and divert their case from the criminal court system. Generally speaking, the defendant should complete the program within 3-6 months with proper monitoring, fees, classes and/or community service.
A diversion program involves “diverting” a case from the court system in exchange for a person completing specific tasks like counseling or community service. After the special conditions are completed, the case is closed, the charges are dropped entirely, or the charges are reduced to a less severe offense.
Back on Track (BOT) is a DUI diversion program for defendants arrested for driving under the influence. This safe driving initiative was created by the Miami Dade State Attorney's Office and prosecutors determine whether first-time DUI defendants are eligible for the program.
