The answer is yes, through a process called vacatur, i.e., having the award vacated or canceled. The vacatur process is set forth in two statutes: the Federal Arbitration Act and the applicable state arbitration act governing the dispute. Depending on the case, one or both statutes may be applicable.
You can only appeal arbitration decisions if you allow as much in the contract, or if the contract is silent on the issue. If the parties decide in their contract that there will be no appeal on any issue, then there can be no appeal. The courts uphold these agreements.
What is the monetary limit for the Special Arbitration Forum? Compulsory arbitration is applicable to a maximum of $250,000 contribution sought per claim. Claims for separate parties arising out of the same accident, occurrence, or event are considered separate claims.
