In general a defendant may post 10% of the bond that was set unless the Judge's order says "No Percent." For example, if the Judge orders a $5,000 bond then $500 must be posted. The full amount of the bond must be posted if the Judge orders it.
Upon conclusion of the court case, the Clerk's Office will review the file for any possible refunds. The Clerk will only process a bond refund after all other financial obligations are met. Bond refunds will be processed within 10-14 days of the court appearance.
A Bond Claim Must be filed within 180 days from the last date of furnishing work or materials on the job. Must be served in writing on the Secretary of Transportation, with copies to the prime contractor, subcontractor and the bonding company. May need to be followed up by a lawsuit.
