This process is called mortgage foreclosure. Trust deed foreclosures comprise the majority of foreclosures in Nevada. A trust deed foreclosure is non-judicial, meaning your bank, lender, or mortgage servicer does not need to go to court to foreclose and sell your home.
The law also introduces new foreclosure sale protections to help homeowners avoid losing equity. If a listing agreement with a licensed real estate broker is submitted at least five business days before the foreclosure sale, the sale must be postponed for at least 45 days.
A lis pendens must be filed with both the county recorder and the circuit court clerk. After the action has reached pending status, the lis pendens must be drafted and submitted to the county recorder to be recorded for public record. This does not end this part of the process.
There is no specific time frame for how long a lis pendens is valid. Rather, a lis pendens is valid until it is expunged or the underlying case is resolved. If not expunged, a lis pendens is often removed as part of a settlement agreement reached between the parties.
What is a lis pendens? (CCP § 405.21) A lis pendens – also called a notice of pendency of action – is a special type of legal document filed with a county recorder. Though its use is limited to lawsuits involving real property claims, its effect is powerful.
Removing a Lis Pendens in California Other than resolution of the pending lawsuit, the only way to remove a lis pendens is by expungement, which requires a court order from a circuit judge.
The Nevada Notice of Right to Lien or 31 Day Preliminary Notice is a precise and necessary document to preserve your ability to record a mechanics lien and collect on non-payment. If the notice does not conform to the Nevada Revised Statutes, one could lose their ability to perfect a mechanics lien.
File a request with the court to remove the lis pendens. Provide the legal reasons the lis pendens is improper, offering proof, for example, that the lis pendens affects real estate that is not connected to the litigation. If the lawsuit is frivolous and merely intended to harass the property owner, offer proof.
