A defendant does not waive any defense it may have to an action, however, by removing the case from state to federal court. A defendant may, for example, move to dismiss for lack of personal jurisdiction after removing a suit.

Unlike personal or territorial jurisdiction, lack of subject-matter jurisdiction cannot be waived. A judgment from a court that did not have subject-matter jurisdiction is forever a nullity.

Filing a notice of appearance of counsel does not, by itself, waive personal jurisdiction.
