FAQ

Substitution of Criminal Defense Counsel Opinion rules that another member of a lawyer's firm may substitute for the lawyer in defending a criminal case if there is no prejudice to the client and the client and the court consent.

Personal Reasons: The attorney may have personal issues, health problems, or changes in their practice that necessitate withdrawal. Inability to Provide Adequate Representation: If the attorney feels they can no longer adequately represent the client due to changes in the case or other circumstances, they may withdraw.

The client's replacement counsel who is a member of the same law firm as the attorney of record may file a notice of substitution of counsel. The notice of substitution must include a representation that the client has been informed of and consents to the substitution.

This process is called "Consensual Substitution of Counsel." A new attorney may replace the current attorney. A new attorney may now represent a client who previously was a self-represented party.

An interrogatory is a method of questioning a witness in writing. The attorney presents a list of written questions to a witness, and the witness provides written responses.

However, you can object to interrogatories that call for legal conclusions. You can also object to questions if they are not at all related to the court case. To object, you need to write out the reasons for the objection instead of answering the question.

Read the question very carefully. Answer only the question that is asked, and avoid the temptation to over-explain your answer. If the question contains several parts, you may break your answer into parts as well. It is also possible that you might object to the question.

Draft Interrogatories Strategically Only ask specific questions that address the crux of the matter where possible. Avoid board or vague questions. The opposing party's legal team may simply file objections against these, citing irrelevance, wasting your time. Also, ask questions sequentially.

Each interrogatory shall be answered separately and fully in writing under oath, unless it is objected to, in which event the reasons for objection shall be stated in lieu of an answer.
