FAQ

G.S. 1A-1, Rule 4. (a) Summons - Issuance; who may serve. - Upon the filing of the complaint, summons shall be issued forthwith, and in any event within five days. The complaint and summons shall be delivered to some proper person for service.

Service may also be made on the party by electronic mail (e-mail) if the party has consented to receive e-mail service in the case at a particular e-mail address, and a copy of the consent is filed with the court by any party. Such e-mail must be sent by P.M. Eastern Time on a regular business day.

The word “process” is a term that covers nearly all acts of the court. Civil Processing requires a notice to the defendant to appear before the court or subjecting the defendant or his property to the jurisdiction of the court. It encompasses all types of writs, orders, summonses, and notices.

If you want to file a motion, the process is generally something like this: You write your motion. You file your motion with the court clerk. The court clerk inserts the date and time your motion will be heard by the judge. You “serve” (mail) your motion to the other side.

Filing the Documents Take the original and two (2) copies of the Motion to the Civil Division of the Clerk of Superior Court's office in the county where your case is filed. The Clerk will stamp each Motion “filed,” place the original in the Court file and return two (2) copies of the “filed” document to you.

In some circumstances, you file a petition or a motion. The court has several complaint forms that you may use in drafting your complaint. The forms are available online and at the Pro Se Intake Unit. You may also write your own complaint without using a court form.

Service of process is the procedure by one party in a lawsuit or legal proceeding to give another party an appropriate notice of the initiation of legal action .

Surveillance: You can provide surveillance footage showing you were not served at the alleged date or that the service was improper. Mail Records: If there's no mail delivered to you or if you haven't signed the receipt. It can indicate improper service.

Personal service and substituted service are two common types of service of process used in the United States, with personal service being the one most difficult for a defendant to attack for its legality. Another method used to perform service of process is publication. For example, publication in a newspaper.

Fill Out Personal Information: Include the servicer's and recipient's names, addresses, and any other required identification details.
