When Is Discovery Available? In New York Supreme Court actions (other than actions in the Commercial Division) discovery is generally available after the defendant interposes its answer. To serve a discovery request on a nonparty (where permissible), you must follow the procedures in Federal Rule of Civil Procedure 45. You must sign your discovery requests and responses and include your name, address, phone number, and email address (if available).
Standard Timeframe in NY: Under NY CPLR 3130, a party may serve written interrogatories upon another party after the commencement of an action. Typically, the recipient has 30 days from the date of service to respond.
