FAQ

Sending an Answer to a Lawsuit If you wish to dispute a lawsuit, it is very important that you give an Answer to the Plaintiff before the deadline given in the Summons—usually 21 days. If you do not give the Plaintiff an Answer before the deadline in the Summons, the Plaintiff can get a “default judgment” against you.

Proof of Service of Summons (POS-010) Tells the court that you had a summons or other legal papers delivered to (served on) the other party in a case. Lists the papers that were served and tells who they were served on, where, when, and how they were served, and who served them.

Service of summons within the state shall be as follows: (a) Upon an Individual. Upon an individual by delivering a copy to the individual personally or by leaving a copy at the individual's usual place of abode with some person of suitable age and discretion then residing therein.

Common methods to avoid being served Not answering the door. Lying about their identity. Hiding in the closet until the process server leaves. Staying at a family member or friend's home.

Impact on Legal Rights: By not answering a summons, you effectively waive your right to defend yourself in court. This could have long-term implications, such as damage to your credit rating (if a monetary judgment is rendered against you), property liens, garnishment of wages, or other enforcement measures.

A summons is an invitation to come to court. In some cases, the court will schedule a call or a video call for the first appearance instead. In other cases, the court will ask that you file an appearance or an answer. Your summons should say so. It is not an order, so you do not have to do what it says.

Your answer should include the court name, case name, case number, and your affirmative defenses. Print three copies of your answer. File one with the clerk's office and mail (or “serve”) one to the plaintiff or plaintiff's attorney. The plaintiff is the debt collector, creditor, or law firm suing you.

You must give or mail to the person who signed this summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this summons located at: _____________________ .
