Use a Special Interrogatory (sometimes called a Specially Prepared Interrogatory) if you want to write the questions yourself. You use this if you want to ask questions that are specific to your case and are not included on the Form Interrogatory form. A Special Interrogatory doesn't use a specific court form.

Interrogatories allow the parties to ask who, what, when, where and why questions, making them a good method for obtaining new information in a case. There are two types of interrogatories: form interrogatories and special interrogatories.

Interrogatories may, without leave of court, be served upon the plaintiff after filing of the complaint and upon any other party with or after service of the summons and complaint upon that party.

Ask for a court order If the other person does not respond, or their response is still incomplete, you can ask the court to order them to respond. You have 45 days from the service of the most recent responses to ask the court to make an order requiring an answer.

There are four main types of discovery requests: (1) depositions; (2) interrogatories; (3) requests for admissions; and (4) requests for the production of documents. Depositions are formal witness interviews.

Fill out Proof of Service form You can use Proof of Service by Mail (form FL-335). It helps if you fill in the top part of the form with the case and court information. Your server can then fill in the information about how, when, and where they served the papers. Your server must then sign the form.

There are two types of Interrogatories: Uniform and Non-Uniform. The Uniform Interrogatories are in court-approved form, for general use in any case. Questions specific to your case, and outside the scope of the standard form, are Non-Uniform Interrogatories.

Under the discovery rule, a plaintiff's statute of limitations deadline will be extended if they are not aware of the injuries they suffered due to the defendant's fault, and they could not have reasonably discovered the injury.

Relief from Judgment or Order. (a) Corrections Based on Clerical Mistakes; Oversights and Omissions. A court must correct a clerical mistake or a mistake arising from oversight or omission if one is found in a judgment, order, or other part of the record.

Pleadings Allowed. Only these pleadings are allowed: a complaint; an answer to a complaint; a counterclaim; an answer to a counterclaim designated as a counterclaim; an answer to a crossclaim; a third-party complaint; an answer to a third-party complaint; and, if the court orders one, a reply to an answer.
