The Wage and Hour Division (WHD) of the U.S. Department of Labor (DOL) administers and enforces the FLSA with respect to private employment, State and local government employment, and Federal employees of the Library of Congress, U.S. Postal Service, Postal Rate Commission, and the Tennessee Valley Authority.
State labor laws do not apply to employees working for the federal government in the United States. This is due to the Supremacy Clause of the United States Constitution, which declares federal law superior to those of the states.
Exclusion from FLSA coverage The three basic categories of exempt position are executive, professional, and administrative. The agency determined the claimant's work is exempt from coverage under the FLSA based on the executive exemption criteria. The claimant does not dispute the agency's exemption determination.
