In general, when an individual resides in California, they are subject to California's comprehensive and protective labor laws regardless of where their employer is located. California laws also apply to those who are legal residents of other states but are working in California.

California labor laws are renowned for their comprehensive nature, providing many employee protections. However, they primarily apply to individuals who perform work within the state's borders. This includes individuals who physically work in California, regardless of their residency or the location of their employer.

All workers have rights on the job. In California, workers are protected by labor laws. It does not matter where you were born or what your legal status is. Once you are hired, you have rights.

The Professional Exemption sets out eight specific professions (law, medicine, dentistry, optometry, architecture, engineering, teaching, and accounting) that are exempt from the first 12 sections of the Wage Orders. It also addresses certain other professions, including nurses, pharmacists and software coders.

California's Labor Code contains the following provision on at-will employment: “An employment, having no specified term, may be terminated at the will of either party on notice to the other.

Commencing Jan. 1, 2024, California will be going one step further to limit the at-will doctrine. SB 497 will create a rebuttable presumption of retaliation if an employer takes an adverse employment action against an employee within 90 days of that employee engaging in any protected conduct.

If you are terminated for an unlawful reason it can be a wrongful termination, you are entitled to a final paycheck, you are entitled to a notice period before certain mass layoffs, and. you can be constructively terminated.
