The Family and Medical Leave Act (FMLA) and California Family Rights Act (CFRA) provide eligible employees with unpaid leave for qualifying reasons/events (e.g. a serious health condition, child bonding). These leaves provide for job protection/restoration and continuation of health benefits.

The California Family Rights Act (CFRA) provides most employees in California with the right to take up to 12 weeks off work to care for themselves or their family members with a serious health condition, or to bond with a new child.

The Family and Medical Leave Act (FMLA) lets eligible employees take unpaid leave for medical or family reasons. Learn about benefits, requirements, and how to report violations.

BASIC LEAVE ENTITLEMENT The FMLA/CFRA entitles eligible employees up to twelve (12) workweeks of unpaid, job-protected leave each calendar year (January 1st – December 31st) for specified family and medical reasons.

Starting January 1, 2024, employers must provide at least 40 hours or five days off each year to most workers.

In California, “use it or lose it” vacation policies are prohibited. However, employers are only prohibited from taking back vacation time that has already accrued. They can take other measures to limit how much vacation time you can accumulate, such as by capping how many vacation days you can build up.
