FAQ

Tenants have legal avenues available if a landlord continues to enter without permission. The Pennsylvania Landlord-Tenant Act provides specific protections for tenants. In many cases, the tenant may file a complaint with local housing authorities.

Landlords can only enter the rental unit after they've given you notice, which is usually 24 hours (except in the case of an emergency).

With commercial property leases, the vast majority do contain a restriction on assignment. This is generally on the basis that assignment is only permitted with the Landlord's consent given formally, with such consent not to be unreasonably withheld. If the Landlord agrees, a Licence to Assign is drafted by lawyers.

A "Consent to Assignment" clause stipulates that a party must obtain permission from the other party before transferring their rights or obligations under the contract to a third party. This ensures that the original party remains involved in decisions affecting the performance and continuity of the contract.

If your landlord continues to violate your right to privacy, you could sue him or her in small claims court for infliction of emotional distress or trespassing.

A landlord can enter without your permission as long as they comply with the terms of your lease and obey the landlord/tenant laws of where you live.

(a) General rule. --It is unlawful for any landlord ratepayer or agent or employee thereof to threaten or take reprisals against a tenant because the tenant exercised his rights under section 1527 (relating to right of tenants to continued service) or section 1529 (relating to right of tenant to recover payments).

The transfer of a right from one party to another. For example, a party to a contract (the assignor) may, as a general rule and subject to the express terms of a contract, assign its rights under the contract to a third party (the assignee) without the consent of the party against whom those rights are held.

Renters are entitled to privacy, with landlords required to provide notice before entry, except in emergencies. Awareness of these rights is your first step toward a secure and comfortable rental experience.
