FAQ

Both you and the district share the final decisions that are made about your child's program. Ideally, the IEP meeting should follow this process: Discussion and description of your child's current level of functioning (includes academic and non-academic functioning; and functioning in the general curriculum);

Initial IEP meeting (required as a result of an assessment, and after parent consent): Within 60 calendar days from date that the signed Assessment Plan is received by school, all assessments and reports must be completed and the IEP meeting held.

You should have mostly everything prepared at least 5 school days before the IEP meeting. IEP goal progress, current levels (recent report cards & assessments), behavior/social skills updates, proposed accommodations, proposed schedule of services, anything relevant to THAT student, etc.

“I hardly know your child” or “I have only had your child for a couple of weeks and am still getting to know him.” As soon as this statement is made it conveys the impression that you should not be part of the IEP team because you do not know the child sufficiently to develop the IEP to meet the child's needs.

As soon as the parent has consented to the assessment plan, the school must complete the agreed assessment of the student, hold an IEP eligibility meeting, and develop a documented individualized education plan within 60 school days, ing to Cal Ed Code Section 56043(f)(1).

Evaluators must identify your child as having one of the following disabilities for him or her to be eligible for an I.E.P.: autism; deafness; deaf-blindness; emotional disturbance; hearing impairment; mental retardation; learning disability; multiple disabilities; orthopedic impairment; other health impairment, speech ...

The school or district will finalize the IEP after the meeting and send you a copy to sign. Make sure you sign it and return it by the deadline they give you. (Be sure to keep a copy for yourself.) Here's a list of things to double-check before signing an IEP.

Many students starting in fourth grade and up to high school are encouraged to attend the meeting after being thoroughly prepared by teachers, counselors and you. It is a means of involving them in the decision-making and seeking their valuable input and feelings.

Education Law §3604(7) requires 180-days of instruction. Commissioner's Regulation §175.5 requires 990/900 annual instructional hours. Provided these minimums are satisfied prior to Rating Day, districts are not required to schedule additional days of session to end on rating day.
