In Texas, a submission docket/hearing is a process that allows parties in a civil case, such as a protective order case, to submit written arguments and evidence to the court without appearing in person for a hearing.
The only way that the order would not go into effect immediately is to file a post-trial motion called a Motion to Stay and for the judge to grant a “stay,” which prevents the original order from taking effect while the appeal is going on.
An affidavit of nonprosecution is a written statement by the alleged victim in a domestic violence case asking the prosecutor to dismiss the case. The purpose of the affidavit is to convince the prosecutor to dismiss the case.
