It may or may not be subrogatable, as set forth in the chart below. It should also be remembered that some states may offer Med Pay but not PIP, or vice-versa. The statute does not apply to fraud claims. Id. However, lower- tiered subcontractors who unknowingly cover up a defect are not subject to the fraud. You'll need to fill out a claim form. You must file claims within 120 days from the date you provided services, unless there's a contractual exception. Under the Medicare Act, the Part D plan provider has the same lien claim reimbursement rights as an MAO has under a Medicare Advantage plan.
