The Hillsborough County Bar Association is one of the largest voluntary bar associations in Florida with a membership of close to 3,500 attorneys, judges and legal professionals.

Holding yourself out as an attorney before you are licensed falls under the category of “unauthorized practice of law”1 and is typically considered grounds for a character and fitness inquiry.

In most states, lawyers are also issued a unique bar identification number. In states like California where unauthorized practice of law is a major problem, the state bar number must appear on all documents submitted by a lawyer.

Attorneys, lawyers, and counsel have all been educated and trained in law. As explained above, attorneys must pass the bar exam and practice law in court. Lawyers have also taken the bar exam, and may or may not practice law. Counsels provide legal advice, and often work for an organization or corporation.

Now, traditionally, an attorney is a person that has graduated law school, passed the bar exam, and is licensed. A lawyer would be someone that has graduated law school but has not been admitted to practice. However, Florida does not make a distinction between these terms.

Inquiries raised or complaints presented by or to The Florida Bar under these rules shall be commenced within 6 years from the time the matter giving rise to the inquiry or complaint is discovered or, with due diligence, should have been discovered.
