Breaking the nikkah contract does not automatically cause the marriage to be invalid but serves as grounds to annul the marriage.
The "Nikah" is the marriage contract signed by both the bride and groom in front of witnesses. The Nikah must be officiated by a recognized Imam, and the contract should comply with both Islamic law and the Code of Muslim Personal Laws.
There are six elements which need to be fulfilled: (i) the offeror and the offeree; (ii) offer and acceptance; and (iii) the subject matter and consideration. To be legally competent to enter into a contract the parties have to have prudence of sound judgement and be at the age of puberty.
