A support petition is a form that tells both your husband (the respondent) and the Judge what you (the petitioner) want.One of the parents MUST be the birth parent. Unmarried parents must complete an AOP form, otherwise, parentage must be established in court. The Law Department assists local and out-of-state custodial parents in establishing an order of support from non-custodial parents. 1. Fill out a child support modification petition. 2. File the petition with the Family Court that most recently established your order. 3. Spousal support is an amount of money that the court orders one spouse to pay to the other spouse for his or her reasonable needs. A spouse can file a petition in New York Family Court for the other spouse to pay spousal support even if they have not yet filed for divorce.
