"Harass" or "harassing" means knowing conduct which is not necessary to accomplish a purpose that is reasonable under the circumstances, that would cause a reasonable person emotional distress and does cause emotional distress to another.

Harassment by telephone is covered under 720 ILCS 5/26. The law states that a person commits harassment by telephone when he or she uses telephone communication for any purpose listed below. Makes any comment, proposal, request or suggestion which is obscene, lewd, filthy or indecent with an intention to offend.

In certain circumstances, such as when a victim is a minor and accused is over 18, or the defendant has previous convictions for other specific violent offenses, among other things, harassment may be punished as a Class 4 felony, punishable by between one and three years in jail and up to a $25,000 fine.
