Description

This form is for use by a Tenant to terminate a month-to-month residential lease. "Residential" includes a house, apartment, or condo. Unless a written agreement provides otherwise, the Tenant does not have to have a reason for terminating the Lease in this manner, other than a desire to end the lease. A month-to-month lease is one which continues from month-to-month unless either party chooses to terminate. Unless a written agreement provides for a longer notice, 30 days notice is required prior to termination in this state. The notice must be given to the Landlord within at least 30 days prior to the termination date. The form indicates that the Tenant has chosen to terminate the lease, and states the deadline date when the Tenant will vacate the premises. For additional information, see the Law Summary link.

FAQ

562.6 Agreement for termination. If a written agreement is made fixing the time of the termination of a tenancy, the tenancy shall terminate at the time agreed upon, without notice.

A lease option is an agreement that gives a renter a choice to purchase the rented property during or at the end of the rental period. It also precludes the owner from offering the property for sale to anyone else. When the term expires, the renter must either exercise the option or forfeit it.

While each case is unique, for most cases, the tenant must give the landlord written notice and the opportunity to fix the issue. Tenants could face serious financial consequences if they do not follow the proper procedures for ending the lease under the Iowa Code or under the terms of the lease agreement.

A lease purchase provides one avenue to acquire a home if the buyer cannot obtain a mortgage. The renter can use the time during the lease phase to improve his credit score prior to purchasing the home. If the house increases in value during the lease period, the buyer also gets the benefit of the additional equity.

Landlords in Iowa can end a month-to-month tenancy without legal cause with a 30-day written notice.
