18 U.S.C. Sec. 1028(A)(3) is the federal law that prohibits the fraudulent possession of five or more identification documents, authentication features, or false identification documents. Possession of such items can be considered a felony punishable by up to 15 years in prison and/or a fine. The types of identification document, authentication features, or false identification documents covered by 18 U.S.C. Sec. 1028(A)(3) can include, but are not limited to: driver’s licenses, passports, Social Security cards, credit cards, birth certificates, and any other document that can be used to identify an individual. Authentication features can include fingerprints, retinal scans, or other biometric data. False identification documents are documents that have been altered, counterfeited, or otherwise created for the purpose of committing fraud.
