In most instances, the employment contract will not state its expiration date. In such a case, the contract may be terminated at any time by either party. Ordinarily a contract of employment may be terminated in the same manner as any other contract. If it is to run for a definite period of time, the employer cannot terminate the contract at an earlier date without justification. If the employment contract does not have a definite duration, it is terminable at will. This is called employment at will. Under the employment at will doctrine, the employer has historically been allowed to terminate the contract at any time for any reason or for no reason. Salvo por acciones en defensa propia, incurrir durante la jornada de trabajo en faltas de honradez, violencia, amagos, injurias o malos tratos en contra del patron, sus familiares, clientes o personal directivo o administrativo de la empresa, es otra razA³n por la cual se puede separar a una persona del puesto sin

Los plazos varian segAºn la causal que se aplique para el despido. En general, la ley seA±ala que el aviso debe darse al menos con 30 dA­as de anticipaciA³n; de lo contrario, el empleador deberA¡ pagar un mes de aviso a su trabajador.

La ley exige para el despido por inasistencia que la falta sea durante dos dias seguidos, dos lunes en el mes o un total de tres dA­as durante igual periodo.

El despido injustificado es la terminacion de la relaciA³n laboral por la voluntad unilateral del patrA³n, sin que se verifique en la realidad alguna de las causas de rescisiA³n previstas en la Ley Federal del Trabajo.
