Utah Memorandum of Law in Support of Temporary Restraining Order and Preliminary Injunction

A temporary restraining order (TRO) is a legal document issued by a judge before trial that forces or prevents an action for a specified time frame. During court cases that involve trademark infringement or the use of a trade secret, a TRO can halt patent, copyright, or trademark infringement in the short term.

Stay Away Provision: Ordering the abuser to stay at least a certain number of yards or feet away from the victim, his or her home, job, school, and car. The stay-away distance can vary by state, judge or the lethality of the situation, but is often at least 100 yards or 300 feet.

A preliminary injunction is an injunction that may be granted before or during trial, with the goal of preserving the status quo before final judgment.

If a person is subject to a restraining order and violates it, he or she can face serious penalties.Even if the parties no longer desire the restraining order to be in effect, the restraining order is still valid and enforceable while in effect. In order to remove it, the restraining order must be lifted by the court.

If the protective order was issued after July 1, 2020, all of the provisions will typically expire after three years.
