Description

This form is used by a Landlord to demand payment of overdue rent from a residential tenant within 3 days from giving the Notice, in accordance with the laws of your state. (Note: If a written agreement provides for a longer notice, use the notice length stated in the agreement). "Residential" includes a house, apartment, or condo. If the Tenant fails to pay within 3 days, the lease may be considered terminated by the Landlord. The Tenant is informed that the Tenant must either pay the rent or suffer possible termination. If he does not pay, the Landlord may begin eviction proceedings. If the Landlord does not elect to proceed with termination or eviction, but instead agrees to accept rent after the termination date stated in the Notice, the lease is generally reinstated.

In BC, the landlord can quickly evict a tenant for not paying rent. This clause is shown in Section 46 of the Residential Tenancy Branch (RTB). A tenant can be evicted even if they are even a few dollars short or pay rent a day late.

In Michigan, the law allows for faster access to court and a quicker resolution in an eviction case than a lawsuit would usually take. It's illegal for a landlord to evict you without going to court and getting an eviction order first.

The Constitution provides that no person's property may be taken away from him/her and that no person may be evicted from his/her home without a court order. This means that an owner or a person in charge of a property (?landlord?), must apply to court before evicting a person (?tenant?) from his/her property.

The landlord, on the other hand, ?can only cancel a tenant's lease if the tenant has breached the lease,? and if, ?after having given 20 business days written notice to the tenant to remedy the breach,? the tenant still fails to comply.

Proper notice A landlord can end a tenancy only for the reasons allowed by the Act. In most cases, the first step is for the landlord to give the tenant a notice in writing that they want the tenant to move out. The proper forms a landlord must use for giving a notice to end the tenancy are available from the Board.

The date to vacate must be at least 15 days from the date the tenant is served the Final Notice to Vacate. For example, if the Final Notice to Vacate was served on January 2, the tenant must move out by January 17.

In Arkansas, landlords cannot evict a tenant or force them to vacate the property without probable cause. As long as the tenant does not violate any rules, they can stay until their rental period ends.

The New Mexico Supreme Court put a pause, or moratorium, on evictions for nonpayment of rent during the COVID-19 pandemic, but in Bernalillo County the moratorium ended on March 31, 2022. After that date, courts in Bernalillo County can now order tenants to move out for lease violations including missing rent payments.
