A temporary restraining order is a court order issued to prevent contact between (the Petitioner) the person requesting the order and against (the Respondent) the person who is to not have contact with the Petitioner. There can only be one Petitioner and one Respondent per action.
Whoever violates a temporary restraining order or injunction issued under this section shall be fined not more than $10,000 or imprisoned not more than 9 months or both.
As this provision makes clear, not only is direct contact prohibited between the parties following a domestic abuse arrest, but the arrested individual also cannot have a third party contact the alleged victim. The purpose of this particular no-contact rule is to allow a cooling-off period for the parties.
The temporary order lasts for 14 days or until the full court hearing and it can be extended once for 14 days if the respondent could not be served or if the parties consent. A final domestic abuse restraining order, also called an injunction, will last for up to four years.
