Wisconsin Public Defender Response Concerning Recoupment refers to a set of policies and procedures for reimbursement of public defender services. The Wisconsin Public Defender (PD) is responsible for providing legal representation to indigent defendants in criminal and juvenile delinquency cases, and for recovering costs associated with the provision of these services. There are two types of Wisconsin Public Defender Response Concerning Recoupment: Court-Ordered Recoupment and Voluntary Recoupment. Court-Ordered Recoupment is when a circuit court orders a defendant to pay all or part of the costs of appointed counsel services. Voluntary Recoupment is when a defendant, or an individual on the defendant’s behalf, voluntarily agrees to pay all or part of the costs of appointed counsel services. The PD has established policies and procedures for both court-ordered and voluntary recoupment. This includes a payment plan agreement, collection procedures, and financial hardship options.
