A Wisconsin Motion to Vacate, Set Aside, or Correct a Sentence — 2255 Motion, is a type of post-conviction relief available in the state of Wisconsin. It is a legal motion filed in a criminal court which requests the court to vacate, set aside, or correct a sentence that has been imposed on a criminal defendant. This motion can be brought by a criminal defendant, their attorney, or an attorney appointed by the court. There are two types of Wisconsin Motion to Vacate, Set Aside, or Correct a Sentence — 2255 Motions: the 2255(a) Motion and the 2255(b) Motion. The 2255(a) Motion is used when the defendant believes the conviction or sentence was imposed in violation of the United States Constitution, a Federal Statute, or a Supreme Court decision. The 2255(b) Motion is used when the defendant believes there is newly discovered evidence that could have been used to acquit the defendant or reduce the defendant's sentence.
