Washington Order Deferring Prosecution (WHOP) is a form of criminal justice diversion program available in Washington state. It is an alternative to the traditional criminal justice system, allowing certain eligible defendants with non-violent offenses to avoid criminal prosecution and have their charges dismissed upon successful completion of the program. WHOP offers individuals the opportunity to get their charges dismissed, while also providing accountability and a path to rehabilitation. There are two types of Washington Order Deferring Prosecution: Deferred Prosecution and Deferred Sentencing. Deferred Prosecution allows a defendant to participate in a program for a set period of time, typically one year, and upon successful completion, their charge is dismissed. Deferred Sentencing allows a defendant to plead guilty to their charge and, upon successful completion of the program, their sentence is reduced or dismissed. WHOP programs typically involve a range of services and are tailored to the individual’s needs. Depending on the individual’s circumstances, this may include counseling, education, community service, substance abuse treatment, and/or restitution.
