10.7 Civil Rights-Title VII-Hostile Work Environment Caused by Non-Immediate Supervisor or by Co-worker-Claim Based on Negligence is a type of claim brought under Title VII of the Civil Rights Act of 1964. This type of claim alleges that an employee has suffered discrimination in the form of a hostile work environment caused by a non-immediate supervisor or by a co-worker, and that the employer was negligent in allowing the hostile work environment to exist. This type of claim can be based on a variety of scenarios, such as harassment based on race, religion, gender, national origin, age, disability, or sexual orientation. In order for an employee to succeed on this type of claim, they must show that the conduct was severe or pervasive enough to create an objectively hostile work environment, that the employer knew or should have known about the conduct, and that the employer was negligent in addressing the hostile work environment.
