18 U.S.C. Sec. 1029(E)(7) defines a "Credit Card System Member" as a financial institution, retailer, or other entity that has the contractual right to provide credit or debit cards, credit or debit card numbers, or other means of access to a credit or debit card account. This definition includes banks, credit unions, retailers, and other entities that have contracted with a credit card issuer to provide access to a credit or debit card account. The Credit Card System Member can also refer to the credit card issuer itself. There are two types of Credit Card System Members: primary members, which are the entities that issue or acquire the credit cards; and secondary members, which are the entities that serve as intermediaries between the primary members and the merchants or consumers.
