Sec. 1029(E)(3) DEFINITION OF "UNAUTHORIZED ACCESS DEVICE" is a definition of what constitutes an unauthorized access device under U.S. federal law. It states that an "unauthorized access device" is any device, hardware, or software, or other means of accessing a protected computer without the express authorization of its owner or operator. This includes, but is not limited to, any counterfeit access device, any unauthorized access device, or any device-making equipment that is used to produce counterfeit access devices. There are two main types of unauthorized access devices: counterfeit access devices and device-making equipment. Counterfeit access devices are those that are made to look like valid access devices, such as credit cards, ATM cards, or any other device that can be used to gain access to a protected computer without authorization. Device-making equipment is any hardware or software that is used to produce counterfeit access devices.
