The Tennessee AFFIDAVIT-Affidavit to Waive Inheritance Tax Return(Probate) is a form used to waive the inheritance tax return that is typically required for estates in Tennessee. This affidavit is only available to estates that are valued at less than $1 million. There are two types of Tennessee AFFIDAVIT-Affidavit to Waive Inheritance Tax Return(Probate): one for estates with a total value of less than $200,000, and one for estates with a total value of between $200,000 and $1 million. For estates with a value of less than $200,000, the affidavit must be signed by all the heirs and be notarized. For estates with a value of between $200,000 and $1 million, the affidavit must be signed by all the heirs, notarized, and include a copy of a bond in an amount equal to the value of the estate. Both types of affidavits must include the names and addresses of the heirs, the decedent's name and date of death, a list of the assets and liabilities of the estate, and a statement that the heirs waive their right to receive an inheritance tax return.
