Oklahoma Loss of Parental Consortium- Elements of Liability is a type of claim that is made in the state of Oklahoma when a parent suffers the loss of their child's companionship or guidance due to a third-party negligence. This type of claim is a type of tort claim, and can include damages such as emotional distress, fear, sorrow, and mental anguish. The elements of liability for Oklahoma Loss of Parental Consortium- Elements of Liability include: 1. A legal duty of care owed by the defendant to the plaintiff; 2. A breach of that duty; 3. Actual and proximate causation of the breach; 4. Damage to the plaintiff's parental relationship with their child; 5. Specific damages as a result of the breach; and 6.
