New York Notice of Election of Not For Profit Corp Or Unincorporated Assoc To Exclude Salaried Executive Officer From WC Coverage is a form used by non-profit organizations and unincorporated associations in New York to exclude an executive officer who is not receiving a salary from Workers’ Compensation coverage. This form must be completed and submitted to the Workers’ Compensation Board of New York. There are two types of Notice of Election forms available for this purpose: Type A and Type B. Type A is used for non-profit corporations and unincorporated associations that do not have employees other than executive officers. Type B is used for non-profit corporations and unincorporated associations that have other employees in addition to executive officers. Both types of Notice of Election must include the name and address of the non-profit corporation or unincorporated association, the name and address of the Executive Officer, and the date on which the election is made. The form must also be signed by the Executive Officer who is being excluded from Workers’ Compensation coverage. Once the Notice of Election has been completed and submitted to the Workers’ Compensation Board, the Executive Officer will be excluded from Workers’ Compensation coverage. The non-profit corporation or unincorporated association must also provide written notice to the Executive Officer that they are now excluded from Workers’ Compensation coverage. This notice must be provided within 10 days of the election being made.
