To legally change your name in North Dakota, you must file a petition with the District Court of the county in which you have been a bonafide resident during the past six (6) months. Furthermore, you must be at least eighteen (18) years old and a citizen or permanent resident alien of the United States.

A: The law requires that you publish the Order to Show Cause form showing you are asking to change your name, and the date of your court hearing, to help prevent fraud by letting people know you are changing your name, and giving them a chance to object.

The Court will schedule a hearing for your Name Change. That hearing will be about 6-8 weeks after you file the Petition. Almost always, you get your judge-signed Court Order on the hearing date. Some courts take longer than that because of cutbacks and scheduling problems.

The notice must be published in one issue of the Gazette and in one issue of a newspaper circulating in the district in which he or she is resident. Applicants must seek an exemption from the Director if they wish to be exempt from publication.

Ask for the notices and records department. Explain that you need to publish notice of your new name. Note that in some jurisdictions, the county clerk can provide a list of newspapers to contact. Send in your notice of name change and pay the filing fee.
