The Maryland Motion for Stay of Service of Earnings Withholding Order is a court order issued by the Circuit Court of Maryland that temporarily stops an employer from withholding wages from an employee's paycheck. This motion is usually filed by the employee in order to protect their income from being garnished due to a delinquent debt. There are two types of Maryland Motion for Stay of Service of Earnings Withholding Order: Temporary and Permanent. A Temporary Motion for Stay of Service of Earnings Withholding Order stops the employer from withholding wages until a court hearing is held, while a Permanent Motion for Stay of Service of Earnings Withholding Order prevents the employer from withholding wages until the underlying debt is paid in full. In either case, the employee must provide the court with proof of their financial hardship in order to be granted relief.
