A Kentucky Petition for Expungement (For Misdemeanor, Violation, or Traffic Infraction Conviction) is a legal action that allows individuals to have criminal convictions or arrest records removed from their public record. This includes misdemeanors, violations, and traffic infractions. The petition is filed with the Court of Justice in the county where the conviction was obtained. There are two types of Kentucky Petition for Expungements: the Standard and the Sealed Record Expungement. The Standard Petition for Expungement is a petition that allows individuals to have their criminal conviction or arrest record removed from their public record. It does not, however, remove the record from the court’s records. The Sealed Record Expungement is a petition that allows individuals to have their criminal conviction or arrest record removed from the court’s records and sealed from public view. In order to be eligible for a Kentucky Petition for Expungement, the individual must meet certain criteria. The criteria vary depending on the type of conviction or arrest record being expunged. Generally, the individual must have completed all terms of the sentence and not been convicted of any further offenses for a period of five years. Additionally, the individual must not be currently under supervision for a criminal offense and must not be currently charged with any criminal offense. Once the Petition for Expungement is filed, the petition is reviewed by the court in order to determine if the individual meets the eligibility criteria and if the petition should be granted. If the petition is granted, the criminal conviction or arrest record is removed from the individual’s public record and, in the case of a Sealed Record Expungement, sealed from public view.
