Illinois Joint Simplified Dissolution of Marriage (SD) is an expedited divorce process that allows couples who meet certain criteria to legally end their marriage quickly and inexpensively. The SD process is appropriate for couples who agree on all issues of their divorce, including child custody, child support, spousal support, division of property, and debt. In order to qualify for the SD process, both spouses must have been Illinois residents for at least 90 days before the filing of the petition, have no minor or dependent children, be able to agree on all divorce-related issues, and have fewer than $10,000 in marital assets and liabilities. There are two types of Joint Simplified Dissolution of Marriage in Illinois: Uncontested Joint Simplified Dissolution of Marriage and Agreed Divorce. Uncontested Joint Simplified Dissolution of Marriage are available when both spouses are in agreement on all divorce-related matters. Agreed Divorce is available when the parties have an agreement on all divorce-related matters but do not meet the criteria for an Uncontested Joint Simplified Dissolution of Marriage.
