Idaho Summons — Eviction Proceedings is a legal process used to evict a tenant from a rental property in the state of Idaho. This process is initiated by a landlord when a tenant has failed to comply with the terms of the lease or rental agreement. It includes the serving of a summons and complaint by a sheriff or other authorized official, a court hearing, and, if the landlord is successful, a writ of restitution. There are two types of Idaho Summons — Eviction Proceedings: Summary Process and Non-Summary Process. Summary Process is the faster and simpler of the two, and it is used when the tenant has violated a lease agreement or has failed to pay the rent. Non-Summary Process is more complex and requires that the tenant has committed some other violation, such as damage to the property or illegal activity on the premises.
